Nolivé Terms & Conditions

Effective Date: 16 September 2026

Welcome to Nolivé.

These Terms and Conditions (“Terms”) govern your access to and use of the Nolivé website, services and travel-related offerings.

By accessing or using the Nolivé website, submitting an enquiry, requesting a service, making a booking or purchasing a Nolivé service, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the website or Nolivé services.

1.About Nolivé

Nolivé is a travel service designed to connect travellers with destination experts, known as Livé, who provide personalised destination guidance and travel support.

Depending on the service selected, Nolivé may assist with travel planning, destination recommendations, itinerary development, travel-related arrangements and ongoing support.

Nolivé may also work with independent third-party travel suppliers and service providers, including accommodation providers, airlines, transport companies, tour operators, activity providers, restaurants, travel insurance providers and other travel businesses.

3.Use of the Website

You agree to use the Nolivé website lawfully and responsibly.

You may not:

  • use the website for unlawful, fraudulent or misleading purposes;
  • attempt to gain unauthorised access to the website or its systems;
  • interfere with the operation or security of the website;
  • copy, reproduce, distribute or commercially exploit Nolivé content without permission;
  • impersonate another person or provide false information;
  • introduce malicious software, viruses or other harmful material; or
  • use the website in a manner that could damage Nolivé or another person’s rights.

Nolivé reserves the right to suspend or restrict access to the website where reasonably necessary.

4.Nolivé Services

Nolivé provides personalised travel planning and destination-support services.

The exact services provided will depend on the package or service purchased and will be communicated to you before your purchase or booking is confirmed.

Nolivé may modify, improve or discontinue aspects of its services from time to time.

A service or itinerary provided by Nolivé is intended to assist you with planning and enjoying your trip. It does not guarantee that every recommendation, activity, restaurant, attraction, accommodation or other travel service will be available at the time of travel.

5.Livé Destination Experts

Livé destination experts provide destination knowledge, recommendations and travel support through Nolivé.

A Livé’s recommendations are based on information available to them and their destination knowledge. Travellers remain responsible for making their own final decisions regarding travel arrangements.

Where a Livé is an independent service provider, they are not an employee of Nolivé unless expressly stated otherwise.

Nolivé will take reasonable steps to select and work with suitable Livé experts, but cannot guarantee the availability, conduct or performance of an individual Livé at all times.

Nolivé may replace a Livé where reasonably necessary.

6.Third-Party Travel Suppliers

Travel services may involve third-party suppliers.

These may include airlines, hotels, lodges, transport providers, tour operators, activity providers, restaurants, guides, travel insurance providers and other businesses.

Third-party services are subject to the terms, conditions, cancellation policies and rules of the relevant supplier.

Where a third-party supplier is responsible for providing a particular service, Nolivé does not control that supplier’s operations.

Travellers should review the applicable supplier’s terms before confirming a booking.

7.Travel Documents and Requirements

You are responsible for ensuring that you have all documents and permissions required for your trip.

This may include:

  • a valid passport;
  • visas and permits;
  • required vaccinations or health documentation;
  • travel insurance;
  • proof of accommodation;
  • required entry or transit documentation;
  • parental or guardian documentation where applicable; and
  • any other documents required by the destination country or relevant authorities.

Nolivé may provide general information or guidance regarding these requirements, but travellers remain responsible for confirming the requirements applicable to their individual circumstances with the relevant authorities.

Travel requirements can change without notice.

8.Travel Insurance

Nolivé strongly recommends that travellers obtain appropriate travel insurance before travelling.

Depending on the circumstances, suitable insurance may include cover for medical expenses, cancellation, interruption, baggage, delays, emergency assistance and other travel-related risks.

Unless expressly stated otherwise in writing, travel insurance is not included in Nolivé services.

9.Prices and Payments

Prices for Nolivé services will be communicated to the traveller before purchase.

Prices may vary depending on the service selected, destination, number of travellers, trip requirements and services included.

Unless expressly stated otherwise, third-party travel costs are separate from Nolivé service fees.

Payment must be made using the payment method and within the timeframe communicated by Nolivé.

A booking or service may not be considered confirmed until the required payment has been received and confirmation has been provided.

Nolivé reserves the right to correct obvious pricing or information errors before a booking is confirmed.

10.Changes to Travel Arrangements

Travel arrangements may be subject to changes by airlines, accommodation providers, transport operators, tour operators or other third-party suppliers.

Nolivé will make reasonable efforts to assist travellers where changes occur.

However, Nolivé cannot guarantee that a third-party supplier will maintain the original itinerary, price, availability or service.

Any additional costs resulting from traveller-requested changes may be charged to the traveller.

11.Cancellations and Refunds

Cancellation and refund rights may depend on:

  • the Nolivé service purchased;
  • the date of cancellation;
  • the payment terms applicable to the service;
  • whether third-party travel arrangements have already been purchased; and
  • the cancellation and refund terms of the relevant third-party supplier.

Where a cancellation policy applies, it will be communicated to the traveller before or at the time of booking.

Amounts that are non-refundable under the applicable third-party supplier’s terms may not be recoverable by Nolivé.

Nothing in these Terms is intended to exclude or limit any consumer right that cannot lawfully be excluded or limited under applicable South African law.

12.Traveller Responsibilities

You agree to provide Nolivé with accurate, complete and current information necessary to provide the Services.

You are responsible for checking information provided to you and promptly notifying Nolivé of any errors.

You are also responsible for:

  • complying with applicable laws and regulations;
  • complying with airline, accommodation and supplier rules;
  • arriving at airports, stations and other departure points on time;
  • maintaining valid travel documents;
  • obtaining appropriate insurance;
  • paying applicable taxes, fees and charges; and
  • behaving respectfully towards Livé experts, Nolivé staff, suppliers and other travellers.

13.Destination Information

Information provided by Nolivé should therefore be treated as guidance and not as a guarantee that a particular service, attraction or destination condition will remain unchanged.

16.User-Submitted Information and Content

If you submit information, photographs, reviews, testimonials or other content to Nolivé, you confirm that you have the right to provide that content.

You must not submit content that is unlawful, defamatory, misleading, discriminatory, threatening or infringes another person’s rights.

Where you provide a testimonial, review or other content for publication, you grant Nolivé permission to use it for legitimate business and marketing purposes, subject to applicable law.

17.Privacy and Personal Information

Nolivé respects the privacy of its travellers and users.

Personal information collected through the website or in connection with Nolivé services will be processed in accordance with applicable data-protection legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

Personal information may be used where necessary to:

  • provide requested services;
  • communicate with you;
  • process bookings and payments;
  • coordinate with relevant travel suppliers;
  • personalise travel services;
  • comply with legal obligations;
  • improve Nolivé services; and
  • communicate relevant information where permitted by law.

Please refer to the Nolivé Privacy Policy for further information regarding the collection, use, storage and protection of personal information.

18.Cookies and Website Technologies

The Nolivé website may use cookies or similar technologies to improve website functionality, understand website usage and enhance the user experience.

Where required by applicable law, appropriate consent or controls will be provided.

19.Third-Party Links

The Nolivé website may contain links to third-party websites.

These websites are operated independently from Nolivé.

Nolivé is not responsible for the content, availability, privacy practices, security or terms of third-party websites.

You should review the relevant third party’s terms and privacy policy before using its services.

20.Limitation of Liability

To the extent permitted by applicable law, Nolivé will not be responsible for losses arising from circumstances outside Nolivé’s reasonable control, including acts or omissions of third-party suppliers, airline disruptions, accommodation issues, weather events, natural disasters, strikes, government actions, border closures, changes in travel regulations, delays, cancellations or other force majeure events.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms is intended to remove or reduce any rights available to consumers under applicable South African consumer-protection legislation.

21.Force Majeure

Nolivé will not be liable for failure or delay in performing its obligations where the failure or delay results from circumstances beyond its reasonable control.

Such circumstances may include natural disasters, pandemics, epidemics, war, terrorism, civil unrest, strikes, government restrictions, infrastructure failures, severe weather, transport disruptions, cyber incidents or other extraordinary events.

Nolivé will make reasonable efforts to communicate material disruptions and assist affected travellers where reasonably possible.

22.Complaints

If you have a complaint regarding Nolivé services, please contact us as soon as reasonably possible.

We will make reasonable efforts to investigate and resolve complaints fairly and promptly.

Complaints should include sufficient information and supporting documentation to allow Nolivé to investigate the matter.

23.Changes to These Terms

Nolivé may update these Terms from time to time to reflect changes to its services, business operations or applicable legal requirements.

The latest version will be published on the Nolivé website with the applicable effective date.

Where required by law, material changes will be communicated to affected customers.

24.Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Nothing in these Terms prevents a consumer from exercising any rights available to them under applicable South African law.

25.Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or amended to the minimum extent necessary to make it enforceable, where legally possible.

The remaining provisions will continue to apply.

26.Entire Agreement

These Terms, together with any applicable booking conditions, service agreement, quotation, cancellation policy and Nolivé Privacy Policy, constitute the agreement governing your use of the relevant Nolivé services.

Where a specific written agreement applies to a particular Nolivé service, that agreement will prevail to the extent of any inconsistency.
